Horse racing is much more than an excuse for gambling. It is a love for the beauty, grace and speed of the horse. It can also be an intellectual battle of examining competing facts and trying to formulate the future from results of the past. In some ways it is an investigation, as performed by an eager detective. And in other ways it can be the thrill of a crossword puzzle, with multiple possible responses, but ultimately only one correct answer. It is a thing of beauty as much as it is a matter of commerce. I have been involved with horse racing in both practical and intellectual ways. From time spent as an apprentice jockey, to later the research of bloodlines in the multimillion dollar world of thoroughbred breeding and sales. And for the past twelve years I have provided speedrating information to the racing industry and public through my company: Speedratings (www.speedratings.com.au).

Buena Vista easily wins Japan Cup - but loses race after stewards' inquiry

Racing jurisdictions around the globe all have different interpretations of what constitutes sufficient interference to cause a winner to be disqualified.

Buena Vista - controversially disqualified in the Japan Cup

The Japanese apply the strictest interpretation - but sometimes it just seems all so ‘unjust’ in implementation.

On Sunday the favourite - and local Champion - Buena Vista ran home an easy (1 3/4 lengths) winner of the 30th Japan Cup. But in staging her withering finishing burst, jockey Christophe Soumillon allowed the champion mare to deviate off a straight line and she brushed subsequent 2nd placegetter Rose Kingdom.

While Soumillon was still celebrating the victory stewards launched an inquiry into the (minimal) interference. Some 30 minutes later Buena Vista was disqualified and Rose Kingdom announced as the new winner of the Japan Cup.

Logic would say that the best horse did not win the Japan Cup - coming as Buena Vista did from far behind Rose Kingdom, and easily sweeping past for a comfortable win. Sometimes the letter of the law appears harsh and unyielding.

Watch the replay and decide for yourself:
